Stamp Duty Explained: How It Is Calculated and How to Find Your State's Rate
Understand what stamp duty is, how it is calculated on property in India, how circle rates affect it, how to find your state's current rate and ways to avoid overpaying legally.
Stamp duty is often the biggest single cost after the price of the property itself. It is a state tax, so the rate, the exemptions and the way it is paid differ from state to state. Many buyers are surprised by the amount, or by the fact that it was calculated on a value higher than the price they agreed.
This guide explains how stamp duty works and how to find the correct rate for your property without relying on guesswork.
In short: Stamp duty is a state tax on documents such as sale deeds. It is usually a percentage of the higher of the sale price and the government's circle rate or guideline value. Rates change by state, property type, location and sometimes by the buyer's gender or age, so get the current figure from your state's official source.
What stamp duty and registration fee are
- Stamp duty is tax levied by the state on the document that records a transaction. It comes from the Indian Stamp Act, 1899, as amended by each state, and from state laws.
- Registration fee is a separate charge for recording the document with the registration department.
Both are paid at the time of registration. See the property registration process for the full steps.
How the amount is calculated
The basic formula is simple:
Stamp duty = duty rate × taxable value
The taxable value is usually the higher of:
- the price in the sale deed, and
- the value fixed by the state for that area, called the circle rate, guideline value, minimum value or market value guideline, depending on the state.
Why? The government wants to prevent buyers and sellers from showing a very low price on paper.
A worked example
These rates are assumed for the example only, so that you can see the method. Suppose a state charges 5% stamp duty and 1% registration fee. You agree to buy a flat for ₹50 lakh, but the circle rate value of that flat comes to ₹55 lakh.
| Item | Calculation | Amount |
|---|---|---|
| Taxable value | Higher of ₹50 lakh and ₹55 lakh | ₹55,00,000 |
| Stamp duty | 5% of ₹55 lakh | ₹2,75,000 |
| Registration fee | 1% of ₹55 lakh | ₹55,000 |
| Total | ₹3,30,000 |
If the duty were charged on the ₹50 lakh price instead, the total would be ₹3,00,000. The ₹30,000 difference is the cost of the circle rate being higher than the price. Many states also have a tolerance, or an exemption for certain buyers. Check yours.
What affects the rate
- State and local body. Each state sets its own rates, and some add a surcharge or local body duty in cities.
- Type of document. A sale deed, gift deed, lease, mortgage and partition deed are each taxed differently.
- Type of property. Residential, commercial, agricultural and plots can have different values.
- Location. Circle rates vary by locality, sometimes by street.
- Buyer's profile. Some states give a concession to women buyers or senior citizens. Others do not.
- Property features. Floor, age of building and built-up area may change the guideline value.
- Government schemes. Affordable housing or certain schemes may get lower duty or an exemption.
How to find your state's current rate
Do not rely on a blog, a broker or a number you heard. Rates are revised, and an old figure can be wrong. To get the correct number:
- Open the website of your state's registration or stamp department. Many states publish rates, circle rate lists, and online calculators. Search for your state's "registration and stamps department".
- Use the official circle rate or guideline value list for your district, locality and property type.
- Use the department's calculator, if available, to estimate the duty and fee.
- Confirm at the sub-registrar's office or with a local lawyer before you budget.
- Check recent notifications, since rates and exemptions change by notification.
For Bihar, rates and the process are with the state's registration department. Because sources disagree on some Bihar percentages, this site does not publish a figure. Check the department's website for the current rate.
How stamp duty is paid
- Physical stamp paper from authorised vendors, in some places.
- E-stamping through authorised agents, with a certificate that you attach to the deed.
- Online challan through the state portal.
- Franking, where the bank or an authorised centre stamps the document.
Whichever method you use, verify the stamp certificate or receipt. Fake or invalid stamp papers are a known risk, and a deed with insufficient duty can lead to penalties and delay.
Stamp duty on different situations
- Under-construction flats. In many states, duty is paid on the agreement for sale or at the time of registration. Rules differ.
- Resale flats. Duty is paid on the sale deed, based on the agreement price or circle rate.
- Gifts and inheritance. Gift deeds attract duty in many states, with concessions for close relatives. Wills are not usually charged, since they do not transfer anything until death.
- Leases. Duty depends on the rent and the lease term.
- Mortgage and loan documents. The loan agreement and deed of mortgage may attract their own duty.
Tax angle
Stamp duty and registration charges paid on buying a home can qualify for a deduction under the home loan principal repayment benefit, in the year of payment, within limits. The Income-tax Act has been renumbered, so confirm the current section with a tax professional. See home loan tax benefits.
Ways to reduce the burden legally
- Check concessions. Some states charge lower duty if a woman is a co-owner or sole owner, or for senior citizens.
- Register before a planned rate hike, if the state has announced one.
- Use the right document. Ask your lawyer which structure applies and does not break the law.
- Check the circle rate for your exact locality and category, not the nearby area.
- Challenge a wrong valuation with the relevant authority if the circle rate does not match the actual property, such as a plot with poor access. Many states have a process.
What not to do
- Understating the price in the deed. This is evasion, and can lead to penalties, a re-valuation, trouble with your loan and tax notices later.
- Paying part in cash to reduce the paper price. See how to negotiate.
- Using unverified agents to buy stamp paper.
Frequently asked questions
Is stamp duty the same across India?
No. Each state sets its own rates, and some cities add extra charges.
Who pays stamp duty, buyer or seller?
By convention the buyer pays, but the law allows the parties to agree otherwise. Put it in the agreement.
Is stamp duty refundable?
In some cases, such as when a deed is cancelled or not used within the time allowed, a refund may be possible in the manner the state prescribes. Apply promptly.
Do I pay stamp duty again if I take a home loan?
The loan documents may attract separate stamp duty. The sale deed duty is paid once for the purchase.
Are circle rates the market price?
Not exactly. They are minimum values set by the government and may be lower or higher than market prices.
